1. Terms

By accessing this School, you are agreeing to be bound by these Terms of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this School are protected by applicable copyright and trademark law.

2. Use License

  1. Permission is granted to temporarily download one copy of any downloadable materials on the School’s website for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
  2. modify or copy the materials;
  3. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);
  4. attempt to decompile or reverse engineer any software contained on the School’s web site;
  5. remove any copyright or other proprietary notations from the materials; or
  6. transfer the materials to another person or 'mirror' the materials on any other server.
  7. This license shall automatically terminate if you violate any of these restrictions and may be terminated by Company at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Disclaimer

The materials on the School’s website are provided 'as is'. The School makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, the School does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.

4. Limitations

In no event shall the School be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on the School’s website, even if the School or an authorized of the School has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

5. Revisions and Errata

The materials appearing on the School’s website may include technical, typographical, or photographic errors. The School does not warrant that any of the materials on its web site are accurate, complete, or current. The School may make changes to the materials contained on its web site at any time without notice. The School does not, however, make any commitment to update the materials.

6. Links

The School has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by the School of the site. Use of any such linked website is at the user's own risk.

7. Site Terms of Use Modifications

The School may revise these Terms of Use for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these Terms of Use.

8. Governing Law

Any claim relating to the School’s website shall be governed by the laws of the School Owner’s home jurisdiction without regard to its conflict of law provisions.



Semi-Custom Branding

The terms below apply specifically to purchases of semi-custom branding, in addition to the general terms outlined elsewhere on this page. Where a term below addresses something not covered in the general terms, the section below applies. Where something conflicts, the terms below take precedence for semi-custom branding purchases.

1. What You're Purchasing

When you purchase a semi-custom brand kit from Katie Harp LLC, you're purchasing a pre-designed brand identity that will be personalized with your business name and your chosen colors. You are not commissioning a fully custom design created exclusively for your business.

2. Personalization Process

After purchase, you'll receive a questionnaire to provide your business name, color preferences, and any other details needed to personalize your kit. Your personalized files will be delivered within about one week of submitting your completed questionnaire, although this is not a guaranteed timeline. Delays in submitting your questionnaire or responding to follow-up questions may extend this timeline.

3. Revisions

Each kit includes one round of refinements after your initial files are delivered. Additional rounds of revisions are available for an extra fee, quoted upon request. Revisions are intended for small adjustments (such as color or spacing) and do not include a full redesign of the logo.

4. Non-Exclusivity

Semi-custom branding may be purchased and personalized by multiple businesses. Your brand is personalized with your name and colors, but the underlying design is not created exclusively for you. Katie Harp LLC makes no guarantee that your brand will be visually distinct from another business using the same base design.

5. Files and Fonts

Upon completion, you will receive your logo files in multiple formats as appropriate.

Logo files are delivered with outlined fonts. This means you can use your logo files immediately, in any size or format, without needing to own the font yourself. However, outlined text cannot be edited as text, and the font file itself is not included or transferred as part of your purchase.

If you would like to use the same font for other materials (such as social media graphics, your website, or printed materials), you are responsible for purchasing your own license directly from the font foundry or a licensed retailer. Katie Harp LLC is not able to share, transfer, or sublicense font files, as doing so violates the terms of most font licenses.

6. License to Use Your Brand

Once your kit is delivered and paid in full, you receive a license to use your personalized brand files for your business, including on your website, social media, marketing materials, signage, and merchandise. This license is for your use in operating your business and is not transferable to another business or individual, and may not be resold.

Katie Harp LLC retains ownership of the original, unpersonalized brand design and may continue to license it to other businesses.

7. Payment and Refunds

Payment is due in full at the time of purchase. Due to the digital nature of the product, all sales are final and non-refundable.

8. Client Responsibilities

You're responsible for providing accurate information on your questionnaire, including your legal business name and any trademark concerns. Katie Harp LLC does not conduct trademark searches and is not responsible for verifying that your business name or chosen colors do not infringe on another party's trademark.

9. Limitation of Liability

Katie Harp LLC provides design services as described above and is not liable for any indirect, incidental, or consequential damages arising from the use of your brand files, including but not limited to lost business, lost profits, or reputational harm.

10. Changes to These Terms

These terms may be updated from time to time. The terms in effect at the time of your purchase will apply to that purchase.
